مبارك الرئيس الثانى فى مصر بعد محمد نجيب يوضع تحت الإقامة الجبرية..مصدررئاسى:الإقامة الجبرية تنتهى بانتهاء حالة الطوارئ..والحاكم العسكرى يختص بتحديد مكان إقامته..وله الطعن على القرار أمام القضاء
كشف مصدر رئاسى بأن الرئيس عدلى منصور الرئيس المؤقت والحاكم العسكرى، قرر وضع الرئيس الأسبق محمد حسنى مبارك، تحت الإقامة الجبرية لمدة 22 يوما وفقا لحالة الطوارئ التى أعلن عنها فى 14 أغسطس الجارى والتى ستنتهى فى 12 سبتمبر المقبل، وتنتهى معها الإقامة الجبرية لمبارك، بانتهاء حالة الطوارئ فى مصر.وقال المصدر إن من حق الرئيس الأسبق أن يتقدم بطعن على قرار الحاكم العسكرى بوضعه تحت الإقامة الجبرية أمام محكمة القضاء الإدارى، فإذا ما قضت بقبول الطعن تنتهى الإقامة الجبرية فورا.
وأشار المصدر بأن قرار الرئيس عدلى منصور وضع مبارك تحت الإقامة الجبرية جاء وسط مخاوف من أن يؤدى قرار إخلاء سبيله على ذمة القضايا المتهم فيها إلى وقوع مصادمات وتوترات بين المواطنين التى تعصف بالبلاد فى أعقاب الإطاحة بالرئيس السابق محمد مرسى، مشيرا إلى أن الحاكم العسكرى هو من يختار المكان الذى سيتم وضعه فيه.
ويعد قرار وضع مبارك تحت الإقامة الجبرية هو القرار الثانى الذى يصدر بعد فرضها أيضا على محمد نجيب، أول رئيس لمصر بعد سقوط الملكية، بعد انقلاب جمال عبد الناصر عليه سنة 1954.
وطبقا لقانون الطوارئ فى الماده الثالثة: لرئيس الجمهورية متى أُعلنت حالة الطوارئ أن يتخذ بأمر كتابى أو شفوى وضع قيود على حرية الأشخاص فى الاجتماع والانتقال والإقامة والمرور فى أماكن أو أوقات معينة والقبض على المشتبه فيهم أو الخطرين على الأمن والنظام العام واعتقالهم والترخيص فى تفتيش الأشخاص والأماكن دون التقيد بأحكام قانون الإجراءات الجنائية وكذلك تكليف أى شخص بتأدية أى عمل من الأعمال.

A source presidential that President Adly Mansour interim president and military ruler, decided to put former President Hosni Mubarak, under house arrest for 22 days according to the state of emergency, which was announced on 14 Aug. and which will expire in 12 September, and ends with house arrest for Mubarak, the end of the a state of emergency in Egypt.
The source said that the former president has the right to submit an appeal on the decision-cum-military ruler under house arrest before the Administrative Court, if ruled to accept the challenge ends house arrest immediately.
The source pointed out that the president's decision Adly Mansour put Mubarak under house arrest came amid fears that the decision to release him pending issues of the accused where to clashes and tensions between citizens that beset the country in the wake of the overthrow of former President Mohamed Morsi, pointing out that the military ruler is choose the place where it will be put in it.
The decision to put Mubarak under house arrest is the second decision issued after also imposed on Mohamed Naguib, the first president of Egypt after the fall of the property, after Gamal Abdel Nasser coup by the year 1954.
According to the Emergency Law in Article III: The President of the Republic when declared a state of emergency to take something written or oral put restrictions on the freedom of individuals at the meeting and move on, accommodation and traffic in places or certain times and the arrest of suspects or dangerous to the security and public order, arrest and license in the inspection of people and places without being bound by the provisions of the Criminal Procedure Code as well as the assignment of any person to perform any of the acts.
